Sanctions

Here are what sanctions can apply if you are found to be non-compliant with the Motor Vehicle Act Regulations (MVAR), Code of Conduct, terms and conditions, agreements with ICBC or any other applicable rule or regulation.

ICBC is committed to protecting the reputation of B.C.’s driver training industry. Non-compliance and poor behaviour must be addressed in a fair and transparent manner so that schools and instructors understand expectations and so that the public feel safe and have recourse to pursue complaints.

Enforcement

Enforcement typically starts with verbal warnings, education and action plans.

If non-compliance continues, you may be issued a written warning or fine.

In cases of serious or repeated non-compliance, you may have your driving school licence, instructor licence and/or your ICBC agreement suspended or cancelled. In certain situations, law enforcement may also be involved.

Determining sanctions

When determining sanctions, we consider the:

  • Scope of non-compliance (i.e. the amount and frequency and the extent of harm to clients, partners and the industry's reputation)

  • Disciplinary record (i.e. history of non-compliance, such as previous warnings, fines, etc.)

  • Other factors, such as whether or not other fraudulent or deceptive practices were involved

Common non-compliance scenarios

Some of the most common cases of non-compliance include:

  • Violations of rules, regulations and agreements

  • Instructors providing driver training without a valid driver training instructor licence or without going through an approved school

  • Not meeting security bond requirements

  • Administrative or road safety infractions

  • Fraud or Criminal Code convictions

  • Booking road tests for students:

    • Without their signed consent

    • Who are not currently in driver training

    • Using the student's personal keyword

  • Non-compliance in regards to record keeping:

    • Missing, filing incomplete, or failing to maintain records

    • Missing, failing to provide, or failing to itemize receipts

    • Falsifying or altering MELT records or modifying ICBC forms
